Terms and Conditions

None of these Terms and Conditions affect your statutory rights when purchasing within the UK.

Definitions
In these conditions the following words have the following meanings unless the context requires otherwise:

"Contract" means any contract between You and Us incorporating these conditions for the sale of Products
"Products" means any products and/or goods ordered from Us by You or to be supplied by Us to You
"We, Us, Our" means Digi UK Ltd.
"You, Your, Yourself" means the person to whom we supply the products.

Orders and Contract
The Contract between You and Us shall come into effect on Our acceptance of Your order.

Delivery
We process Your order straight away in order to ensure prompt delivery using Your selected delivery method. Delivery dates are however not guaranteed and time is not of the essence in relation to such dates. They are also subject to any matter beyond our reasonable control.
We will use our reasonable endeavours to ensure delivery on the dates specified. Please note that we are only able to make delivery of the products to the card holder's billing address and all addresses are manually verified using our bank's database.
Delivery to all addresses is via our nominated courier with smaller items being sent by normal post. Please click here for full details.

Price
The price of the products shall be as shown on our website at the date of the acceptance of the order.
Unless otherwise stated all prices are inclusive of standard delivery to most mainland UK addresses. Please see our delivery page for full details.
Our prices for all orders made within the UK and the European Union are exclusive of VAT for which You shall be additionally liable at the prevailing rate.
We accept Visa and MasterCard. You may supply your credit card information via phone, fax, normal mail or over the Internet.
We are not aware of any documented cases of credit card fraud using Our shopping system over the Internet. All credit card numbers are encrypted in Our software when the order is placed using 128-bit encryption. They are only decrypted after they reach Our computer. They are not held in clear text on any website.

Product Specifications
All the Products We sell are of a technical nature and it is not practical to publish detailed specifications of all the Products. All images, descriptive matter, specifications and advertising on Our website are intended as a guide only and only give an approximation of the Products

Cancellation
You have the right to cancel the order at any time prior to the confirmed delivery date free of charge.
If you are a consumer, you may cancel your orders within 7 working days following receipt of the Products. Under these conditions We agree to refund your money within 30 days of cancellation.
You will be liable for the cost of returning the Products to Us. In the unlikely event that you wish to return the Products, you must contact Us either by email or by telephone first to obtain an authorisation code.
All Products must be returned in the original packaging and complete with all manuals, cables and accessories within 14 days of delivery. A restocking charge may apply for any missing components.

Certain items can not be cancelled once they have been delivered, such as:

  1. Consumable items - i.e. batteries, printer toner, media etc.
  2. Software - specifically Microsoft Office and similar products (unless part of a hardware product - i.e. driver disk etc.).
  3. Earpieces - i.e. mobile and Dect hands free earpieces (once opened)
  4. Film or audio recorded on to DVD, CD or Tape that is protected by copyright.
  5. Books or manuals that are protected by copyright.
Please note these items can be exchanged if faulty, please contact us if you are unsure if an item is excluded from the 7 day cancellation program - we will be happy to advise.

Property and Risk
Risk in the Products shall pass to You at the time of delivery. Delivery shall be deemed to occur at the time when the Products arrive at the place of delivery if We deliver the Products by Our own transport or We arrange transport.
We will retain title and ownership of the Products until We have received payment in full of all sums due and/or owing for all Products supplied to You by Us under this Contract.
Until payment in full of the price for all Products supplied to You the Products shall be stored separately from any products or goods belonging to You or any third party and must be clearly marked and identified as being Our property. You agree that Our employees and/or agents shall be entitled to enter Your premises to check compliance with this clause.
We will only deliver the Products to the cardholder's billing address and Products will not be left without a signature.
From the time of receipted delivery of the Products, any loss or damage to the Products shall be at Your own risk.

Guarantee
All Products are supplied with the manufacturers guarantee unless otherwise stated.
We guarantee that the Products will be free from defects in materials and/or workmanship for a period of 12 months (or longer if so required by law) from the date of delivery unless otherwise stated.
The guarantee in clause 8.1 above is given by Us subject to the following conditions:

  • We shall be under no liability in respect of any faults or defects caused by willful damage, abnormal working conditions, failure to follow Our instructions, misuse, alteration or repair of Products without Our approval, improper maintenance or negligence on Your part or a third party.

Repairs and Replacements
Where any defect in the Products is apparent upon inspection You must inform Us within 7 days of delivery. You can then either return the defective Product to Us directly or We will organise a collection from Your home at Our own cost. Upon receipt of the Products and confirmation of the defect by Our technical engineers You will be offered the following options: -

  • subject to availability, a replacement delivered to You free of charge; or
  • a full refund provided the Product has been verified defective and is complete with all accessories in its original box and packaging.

If the Product is not deemed to be defective by Our technicians then You will be offered the following options: -

  • the return of the Product to You at Your own cost; or
  • a refund of the invoice cost less any applicable delivery charges provided that the Product is "as new" and complete with all accessories in its original box and packaging.

Liability
We shall have no liability for any matters which are outside Our control.
We shall have no liability to You for defective Products, Products not dispatched or Products damaged or lost in transit unless the event is notified to Us within the appropriate time limit set out in this Contract.
We shall have no liability for damage, loss, claims, costs or expenses caused or contributed to by Your continued use of defective Products after a defect has become apparent or suspected or should reasonably have become apparent to You.

If You are a business or if the Products are used wholly or in part for business purposes We shall have no liability to You for any:

  • consequential losses;
  • loss of profits and/or damage to goodwill;
  • economic and/or similar losses;
  • special damages and indirect losses; and/or
  • business interruption, loss of business, contracts, opportunity and/or production.

If the previous clause applies, Our total liability to You shall not exceed the Contract price.

NOTHING IN THIS CONTRACT SHALL EXCLUDE OR LIMIT OUR LIABILITY FOR DEATH OR PERSONAL INJURY DUE TO OUR NEGLIGENCE OR ANY LIABILITY WHICH IS DUE TO OUR FRAUD OR ANY OTHER LIABILITY WHICH IT IS NOT PERMITTED TO EXCLUDE AS A MATTER OF LAW.

NOTHING IN THIS CONTRACT SHALL EXCLUDE OR LIMIT ANY OF YOUR STATUTORY RIGHTS WHICH MAY NOT BE EXCLUDED OR LIMITED DUE TO YOU ACTING AS A CONSUMER. ANY PROVISION WHICH WOULD BE VOID UNDER ANY CONSUMER PROTECTION LEGISLATION OR OTHER LEGISLATION SHALL TO THAT EXTENT, HAVE NO FORCE OR EFFECT.

Privacy Policy
We are committed to protecting Your privacy and will only use the information that We collect from You lawfully (in accordance with the Data Protection Act 1998) and according to SafeBuy Web Trader Code of Practice. We do not use 'spam' which we define as random emails to personal email addresses where the recipient has not been a customer of ours. We collect information about you for 2 reasons: firstly, to process your order and second, to provide you with the best possible service.

We will not email You in the future unless You have given Us Your consent.
We will give You the chance to refuse any marketing email from Us or from another trader in the future.
The type of information We will collect about You includes:

  • your name
  • address
  • phone number
  • email address
  • credit/debit card details
We will never collect sensitive information about You without your explicit consent.

The information We hold will be accurate and correct. You can check this information by emailing us (click here to email).
If you find any inaccuracies We will delete or correct it promptly.

The personal information which We hold will be held securely in accordance with Our internal security policy, the law and the SafeBuy Web Trader Code.
If We intend to transfer Your information outside the EEA We will always obtain Your consent first.
We may use technology to track the patterns of behaviour of visitors to Our site. This can include using a "cookie" which would be stored on Your browser. You can usually modify Your browser to prevent this happening. The information collected in this way can be used to identify You unless You modify Your browser settings.

Complaints
In the unlikely event that You have a complaint about any aspect of dealing with Us please telephone Us as soon as possible on 0870 997 9990 or fax Us on 01386 550644. We hope that We can deal with Your problem in just a few moments on the telephone.
However, if Your complaint is more complex and is submitted in writing, We promise to:

  • acknowledge all written complaints within 5 working days of receipt; and
  • advise You of how long We feel it will take to resolve the complaint; and
  • keep You informed throughout the process.

General
These terms and conditions do not affect your statutory rights.
To order Products through this website you must be at least 18 years of age.
No waiver by us of any breach of this Contract shall be considered as a waiver of any subsequent breach of the same provision or any other provision.
If any provision of this Contract is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of this Contract and the remainder of the affected provision shall be unaffected and shall remain in full force and effect.
This Contract is governed by and interpreted in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.
These conditions shall govern the agreement between You and Us to the exclusion of any other terms or conditions.

 

Delivery

Your order may be shipped via a number of different delivery services, larger parcels and boxed items are normally sent using Initial City Link, but for larger items we will use Palletline. Smaller items are often sent using the regular Royal Mail Postal Service. In almost all cases where we use a courier you will need to sign for the goods. Any general post is sent First Class.
If your order is delivered by courier and you are not there to receive it then you will be left a card so that you can arrange a suitable time for the courier to call again OR collect it from their local depot. If you do not contact the courier then they will re-attempt delivery on the next working day before returning it to our warehouse. Please note with large format TVs over 32 inches in size a next day delivery will incur a charge of £38 including VAT. If the product after a second failed delivery has been returned to our warehouse you can arrange for a new delivery at an extra charge. If you know that you will not be in to accept a delivery it would be wise to arrange delivery to an alternative address, perhaps a friend, relative or workplace. We will need you to fax us a copy of the front and back of your payment card along with the address that you would like us to deliver to. Please note that most large items and valuable consumer electronics will be delivered by courier.

Free Delivery

Our Free delivery service is available for all deliveries within the UK mainland (except for Jersey and Guernsey). We aim to deliver within 4-5 working days from despatch. Our FREE delivery service includes all mainland post code areas, however, for offshore locations including Northern Ireland, an additional cost may apply, if this is the case we will notify you before shipping allowing you to decide whether you still wish to proceed with your order.

Express Delivery

Our Express Service is for next working day delivery at an additional cost of £6.99 ( inc. VAT) per order. Prices correct as of 05/04/2006. Please note that orders placed late in the day (eg: after 5pm) may not be despatched in time to arrive the next day. If a product is not in stock at the time of order it will be despatched to you as soon as it becomes available in our warehouse, if you purchased the Express Delivery service it will then arrive with you the following working day.

We do our best to ensure a prompt delivery, however, we can't be held responsible for any postal delays.
